So, what is an Affirmative Action Plan?
An Affirmative Action Plan (AAP) is a written document containing information and analyses of a federal contractor’s workforce. It is a management tool designed to ensure equal employment opportunity. A central premise underlying Affirmative Action is that, over time, absent discrimination, a contractor’s workforce will generally reflect the gender, racial and ethnic profile of the labor pools from which the contractor recruits and selects.
But, not all federal contractors need an AAP in place.
Federal contractors with 50 or more employees and at least $50,000 in federal contracts must develop a written affirmative action program for minorities, females and individuals with disabilities. And, federal contractors with 50 or more employees and at least $100,000 in federal contracts must develop an AAP for veterans.
However, if your company is a federal contractor with fewer than 50 employees, even if you have more than $10,000 in federal contracts, you are not required to develop a written Affirmative Action Program; but, you do have other Affirmative Action obligations.
If your company received an audit letter from the Office of Federal Contract Compliance Programs (OFCCP) and don’t have an AAP or one that is audit-ready, it is best to act immediately; you have only 30 days to submit your Affirmative Action Plan.
